Massachusetts Drug-Free Workplace
Massachusetts has a set of guidelines and policies in place for maintaining a drug-free workplace. State agencies receiving at least $100,000 in federal funding are required to adhere to the Drug-Free Workplace Act. This includes publishing a statement that notifies employees that the unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance is prohibited in the workplace and specifying the actions that will be taken against employees for violation of such prohibition.
When it comes to drug testing, especially for marijuana, the state of Massachusetts allows employers to enforce workplace policies restricting the consumption of marijuana by employees. The law does not provide protections for cannabis users from their employers, meaning that the use, possession, or impairment due to marijuana in the workplace can be grounds for disciplinary actions, including termination. However, an employee who uses medical marijuana to treat a disability is entitled to reasonable accommodation under the state's disability discrimination law.
