Illinois Drug-Free Workplace
Illinois has a statute known as the Drug-Free Workplace Act, which sets forth requirements for grantees or contractors of the state to maintain a drug-free environment. According to this statute, no grantee or contractor can receive a grant or be considered for a contract for procurement of any property or services from the state unless they certify to maintaining a drug-free workplace. This involves publishing a statement notifying employees about the prohibition of unlawful drug use in the workplace, specifying actions against violations, and establishing a drug-free awareness program. The statute also mandates that contractors and grantees must notify the contracting or granting agency within 10 days of receiving notice of a drug statute conviction for a violation occurring in the workplace by an employee. Failure to comply with these requirements can lead to sanctions, including suspension, termination of contracts, or debarment.
Furthermore, the legalization of recreational cannabis in Illinois has prompted adjustments in workplace policies. The Cannabis Regulation and Tax Act, effective from January 1, 2020, allows employers to enforce zero-tolerance or drug-free workplace policies and to conduct drug testing concerning cannabis use in the workplace or while on call, provided these policies are applied in a nondiscriminatory manner. Employers can prohibit cannabis use in the workplace and require employees who are "on-call" to abstain from marijuana use, with the statute defining "on-call" as an employee being scheduled to be on standby or otherwise responsible for performing tasks, provided they are given at least 24-hour notice of such standby duties.
