Arizona Drug-Free Workplace
Arizona Legislature 23-493.04: States that testing or retesting for the presence of drugs or alcohol by any employer must be carried out within the terms of their written policy that has been distributed to every employee who is subject to testing or that has been made available to employees in the same manner as the employer informs its employees of other personnel practices, including inclusion in a personnel handbook or manual or posting in a place accessible to employees. The employer shall inform prospective employees that they must undergo drug testing.
The written policy must include at least the following:
1. Statement of the employer's drug testing policy
2. Description of employees who will be subject to testing
3. Circumstances/reason for testing
4. Substances for which the employee may be tested for
5. Description of testing methods and collection procedures that will be used
6. Consequences of a refusal to test
7. Any adverse personnel actions that may be taken based on the procedure or results
8. The employee's right to obtain their written test results
9. Employee right upon request, to receive an explanation of positive test results
10. Employer policy statement regarding the confidentiality of the test results
B. Employer reasons for testing
1. Investigation of possible employee impairment
2. Investigation of accidents in the workplace.
3. To maintain safety for employees, customers, clients, or the general public
4. Maintenence of productivity, quality of products or services, and/or security of property/information
5. Reasonable suspicion that an employee may be affected by the use of drugs or alcohol that may adversely affect the performance or work environment
C. Furthermore, employers may be required to undergo random testing
D. An employer may test for drugs and alcohol and all compensated employees including officers, directors, and supervisors must be included in the testing policy.
E. Onsite testing for drugs and alcohol is required.
